
“The National Public Procurement Service, through instruction no. 01 of 27 August, reinforces the need to comply with the Public Contracts Law, Law 41/20 of 23 December, as regards the mandatory notification of the award. It should be noted that the award of procedures for the formation of public contracts must be notified to the SNCP whenever the estimated value of the contract is equal to or greater than 182,000,000.00. This obligation results from the need for better control of public resources and better supervision by the responsible entity. Contrary to the obligation to notify the award under the terms of this instruction, Law 19/19 of 14 August, which amends the Organic Law and Procedure of the Court of Auditors, imposes the need to notify the Court of Auditors whenever the award results from a procedure triggered on the basis of material criteria, under penalty of liability”.
